Terms of Use
These Terms of Use govern your access to and use of WeldDesk, a helpdesk platform operated by Weld Corporation, a company registered in the Netherlands. By accessing or using our services, you agree to be bound by these Terms.
Account Terms
Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our services.
Account Creation
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account credentials.
Account Responsibility
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.
One Person Per Account
Each account is for a single user. You may not share your login credentials with others.
Acceptable Use
You May
- Use WeldDesk for legitimate customer support and helpdesk purposes
- Integrate WeldDesk with your websites and applications
- Customize the platform within the provided options
- Export your data at any time
- Invite team members to collaborate on your workspace
You May Not
- Use the service for any illegal or unauthorized purpose
- Transmit malware, viruses, or any harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service to send spam or unsolicited communications
- Resell, sublicense, or redistribute the service without permission
- Reverse engineer, decompile, or attempt to extract the source code
- Interfere with or disrupt the integrity or performance of the service
- Violate the privacy or rights of others
Service & Pricing
Free Plan
WeldDesk offers a free plan with generous limits. Most users will never exceed these limits.
Usage Limits
Free accounts include up to 5 GB of storage. Users who exceed these limits or require additional features may need to upgrade to a paid plan.
AI Features
WeldAgent AI features are included but may have usage limits. Heavy usage may require a paid subscription.
Price Changes
We reserve the right to modify pricing with 30 days' notice. Price changes will not affect existing paid subscriptions until renewal.
No Refunds
Payments are non-refundable except as required by Dutch law or as explicitly stated otherwise.
Your Data
Ownership
You retain all rights to your data. We do not claim ownership of any content you upload or create.
License Grant
You grant us a limited license to use, store, and process your data solely to provide and improve our services.
Data Protection
We process your data in accordance with our Privacy Policy and applicable data protection laws including GDPR.
Data Export
You can export your data at any time through your account settings.
Data Deletion
Upon account termination, your data will be deleted within 30 days unless legally required to retain it.
Intellectual Property
The WeldDesk platform, including its design, features, functionality, and all related intellectual property, is owned by Weld Corporation and protected by international copyright, trademark, and other intellectual property laws.
"WeldDesk", "WeldAgent", and the WeldDesk logo are trademarks of Weld Corporation. You may not use our trademarks without prior written permission.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- We do not guarantee uninterrupted or error-free service
- We are not responsible for any loss of data due to technical failures
- AI-generated responses are provided for assistance only and may not always be accurate
- You are responsible for ensuring your use complies with applicable laws
Limitation of Liability
To the maximum extent permitted by Dutch law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
- For free plan users, our total liability is limited to €100
Nothing in these Terms excludes or limits liability that cannot be excluded under Dutch law, including liability for death or personal injury caused by negligence.
Termination
By You
You may terminate your account at any time through your account settings or by contacting us.
By Us
We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
Effect of Termination
Upon termination, your right to use the service ceases immediately. We will delete your data within 30 days unless legally required to retain it.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands. For consumers in the EU, this does not affect your statutory rights under local consumer protection laws.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the service at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the modified Terms.
